Terms and Conditions

These Terms and Conditions apply to orders placed in person, through email, through winningimprints.com, as well as our online stores hosted for schools, teams, and companies (collectively referred to as "Organizations") hosted at winninigimprints.chipply.com. By accessing or using our platform, you agree to be bound by these Terms and Conditions.

Definitions

  • "Company," "we," "us," or "our" refers to Winning Imprints & Custom Trophies, Inc., the provider of the online spiritwear store platform.
  • "Platform" refers to our website, mobile applications, and services.
  • "Customer," "you," or "your" refers to any individual who accesses or uses our Platform.
  • "Products" refers to the apparel and merchandise available for purchase on our Platform.
  • "Organization" refers to the school, team, or company for which a specific store is created.

Orders and Payments

  1. All orders are subject to acceptance and availability.
  2. Prices shown on the Platform are exclusive of applicable taxes unless otherwise stated.
  3. Payment must be made at the time of order placement using the available payment methods.
  4. We reserve the right to cancel any order if we suspect fraudulent activity.
  5. Order fulfillment is contingent upon passing our order verification process.
  6. You may be subject to charges or service fees if you cancel or make changes to your order.

Store Campaigns and Timing

  1. Many stores operate as limited-time campaigns with specific open and close dates.
  2. If a store organizer allows orders to be placed after the store has closed, there will be an additional handling fee.
  3. Estimated production and shipping timeframes will be provided for each campaign.
  4. We reserve the right to extend or close campaigns at our discretion, in coordination with the Organization.

Product Information

  1. We make every effort to display Products and their colors as accurately as possible.
  2. Product descriptions, specifications, and pricing are subject to change without notice.
  3. We do not guarantee that the color display on your device accurately reflects the color of the Products.
  4. Minor inconsistencies may occur in the color and materials of our products.

Customization and Personalization

  1. Orders that are decorated will be given a proof for decoration prior to production. Once approved, Winning Imprints will not be responsible for any errors.
  2. Some Products may allow for customization (names, numbers, etc.).
  3. You are responsible for ensuring all customization information is accurate.
  4. Customized items cannot be returned or exchanged except in cases of manufacturing defects.
  5. We reserve the right to refuse any customization requests that contain offensive, inappropriate, or trademarked content.

Intellectual Property

  1. All Organization logos, mascots, and branded elements used on Products are the property of the respective Organization and are used with permission.
  2. You may not use, reproduce, or distribute any content from our Platform without prior written permission.
  3. Customers are responsible for obtaining necessary permissions for copyrighted or trademarked material.
  4. Winning Imprints never knowingly reproduces copyrighted material and does not accept liability for copyright infringement when producing orders. Customers are solely responsible for obtaining legal permission for the reproduction of logos, trademarks and copyrighted material.

Shipping and Delivery

  1. Orders that are placed with the option to ship rather than pick up will be shipped to the address specified during checkout.
  2. Estimated delivery times are provided but not guaranteed.
  3. Shipping costs are provided at checkout.
  4. Risk of loss and title for Products pass to you upon delivery to the carrier.
  5. We are not liable for specific product delays, damages or other claims after our products leave our production facility.
  6. Group orders may be delivered to a central location as specified by the Organization.

Returns and Refunds

  1. Returns may be accepted within 10 days of delivery for defective items only.
  2. Proof of purchase is required for all returns.
  3. Customized items cannot be returned unless defective.
  4. Refunds will be issued using the original payment method.
  5. Shipping costs for returns due to our error will be reimbursed.

Organization Fundraising

  1. Where applicable, a portion of sales may be designated to benefit the Organization as indicated on the store page.
  2. Fundraising amounts will be remitted to the Organization according to the agreement between us and the Organization.
  3. Customers acknowledge that they are not making a direct donation to the Organization but purchasing Products from which the Organization may benefit.

Privacy Policy

  1. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms and Conditions.
  2. By using our Platform, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

  1. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  2. Our total liability arising out of or relating to these Terms shall not exceed the amount paid by you for the Products giving rise to such liability.

Indemnification

You agree to indemnify, defend, and hold harmless our Company, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform.

Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of such changes.

Severability
